The National Consumer Bankruptcy Litigation Center was founded to protect the rights of people who have been granted a fresh start in bankruptcy, but see that fresh start threatened by creditors, collection agents and debt purchasing companies who are hoping to collect a little more money through pressure and deception.

The law regarding discharged debts is really very simple: you no longer owe them.

Unfortunately, unscrupulous creditors and other debt collectors use a variety of tactics to profit from discharged debts. These include:

  • Original creditors selling debts that have been discharged to debt purchasing companies;
  • Creditors, collection agents or debt purchasing companies continuing to report discharged debts as delinquent, or as open accounts, on your credit report;
  • Third party collectors contacting you for payment, and telling you that because they're a different creditor, they're not covered by the bankruptcy discharge

There are many variations on these methods, but the bottom line is clear.

If a debt was discharged in bankruptcy:

  • no one should be contacting you to collect that debt
  • that debt should not be appearing as an outstanding debt on your credit report
